1. Overview

Welcome to The Optimistic Website Company (“we,” “us,” or “our”).
By purchasing, subscribing, or otherwise engaging in any of our products or services, you (“Client”) agree to these Terms of Service.
These terms apply to all projects, subscriptions, and care or hosting plans provided by The Optimistic Website Company.

2. Services

We provide website design, development, hosting, and maintenance services as described on our website and project proposals.
Each project or subscription may have its own scope of work, timeline, and deliverables as outlined in a separate written agreement or invoice.

3. Subscription Term & Billing

12-Month Commitment:
By subscribing to a monthly Website Care Plan, Hosting Plan, or related service, you agree to a 12-month minimum term billed monthly unless otherwise stated in writing.

• Billing occurs automatically every month through our secure Stripe subscription system.

• Early cancellation before the end of the 12-month term will result in a final invoice equal to the remaining months in your agreement.

• After 12 months, the plan continues month-to-month unless cancelled in writing.

• Invoices not paid within 10 days may result in temporary suspension of services.

4. Hosting & Backups

We provide secure managed hosting environments for client websites.
Hosting includes regular software updates, backups, and uptime monitoring.
We are not liable for data loss or downtime caused by third-party services, security breaches, or client-installed code.
Backups are retained for 30 days unless otherwise stated.

5. Ownership & Intellectual Property

Upon full payment, the client owns the final website content, graphics, and layouts created specifically for their project.
We retain the right to display completed work in our portfolio.
All underlying software, frameworks, plugins, and proprietary systems remain the intellectual property of their respective owners or The Optimistic Website Company.

6. Refunds & Cancellations

Because our services involve significant time and resources, payments are non-refundable once work has begun or a subscription cycle has been billed.
Cancellations must be submitted in writing at least 15 days before the next billing cycle.

7. Client Responsibilities

You agree to provide necessary materials (text, images, credentials, etc.) in a timely manner.
Failure to provide required assets may delay project completion.
You are responsible for reviewing and approving deliverables within reasonable time frames.

8. Limitation of Liability

In no event shall The Optimistic Website Company be liable for indirect, incidental, or consequential damages arising from the use of our services.
Our total liability shall not exceed the amount paid for services rendered within the past six months.

9. Updates to Terms

We may update these Terms periodically.
Any changes will be posted at this URL and take effect immediately for new clients or at the next renewal for existing clients.
